TERMS & CONDITIONS

Please read these Terms and Conditions carefully before registering for any Couch Potato Run Club programme. By completing payment and/or attending a CPRC session, you confirm that you have read, understood, and agreed to be bound by these terms in their entirety.

These terms constitute a legally binding agreement between you and Couch Potato Run Club (Pty) Ltd (Reg. 2022/825572/07). If you do not agree to these terms, you may not register for or participate in any CPRC programme.

​

Note: These Terms and Conditions do not constitute legal advice. CPRC recommends that you seek independent legal counsel if you have any questions about your rights and obligations.

SECTION 01

DEFINITIONS

In these Terms and Conditions, the following words and phrases shall have the meanings assigned to them below, unless the context clearly indicates otherwise:

"CPRC" Couch Potato Run Club South Africa, operating under the trading name "Couch Potato Run Club", together with its founders, coaches, representatives, affiliates, and authorised agents.

​

"PROGRAMME" Any structured running programme, event, session, workshop, fun run, open event, or related activity offered, organised, or facilitated by CPRC, whether in person or online.

​

"PARTICIPANT" Any individual who has registered, paid, or otherwise enrolled to attend any CPRC Programme, and any person who attends a CPRC session with or without formal registration.

​

"SESSION" An individual coached running session forming part of a Programme.

​

"COACH" Any CPRC-affiliated coach, facilitator, or session leader responsible for delivering or supervising a Programme or Session.

​

"REGISTRATION" The act of signing up and completing payment for a Programme through CPRC's booking platform or any other authorised channel.

​

"BOOKING PLATFORM" The online ticketing and payment system used by CPRC to process registrations, currently operated via Wix Events or such other platform as CPRC may use from time to time.

​

"WHATSAPP GROUP" Any WhatsApp group or similar messaging group created and administered by CPRC or a CPRC Coach for the purposes of a Programme.

​

"CONTENT" Any photographs, videos, audio recordings, social media posts, marketing materials, or other media produced by or on behalf of CPRC, whether or not featuring a Participant.

​

"PERSONAL INFORMATION" Has the meaning assigned to it in the Protection of Personal Information Act 4 of 2013 (POPIA).

​

"YOU" / "YOUR" The Participant, and where applicable, the parent or guardian of a minor Participant.

SECTION 02

THE PARTIES

These Terms and Conditions govern the relationship between:

​

2.1 CPRC: Couch Potato Run Club (Pty) Ltd, Registration Number 2022/825572/07, trading as "Couch Potato Run Club", with principal contact details as set out in Section 20 of these Terms.

​

2.2 The Participant: The individual registering for, paying for, or attending any CPRC Programme or Session.

​

Where a Participant is under the age of 18, the parent or legal guardian of the Participant shall also be a party to these Terms and shall be jointly and severally liable with the Participant for all obligations arising under these Terms.

SECTION 03

ACCEPTANCE OF TERMS

3.1 By completing Registration for any CPRC Programme, you confirm that you have read and agree to these Terms and Conditions in full.

3.2 Attending any CPRC Session - even without formal Registration - constitutes acceptance of these Terms.

​

3.3 CPRC reserves the right to request confirmation of acceptance at any time, including at the first Session. Participants who decline to accept these Terms may be refused participation with no entitlement to a refund.

​

3.4 These Terms are in addition to, and do not replace, any terms and conditions imposed by the Booking Platform.

SECTION 04

Programme Registration & Eligibility

4.1 Registration is complete only upon receipt of full payment through the authorised Booking Platform. A registration confirmation email will be sent to the email address provided at the time of booking.

4.2 Check your junk/spam folder. Confirmation emails, ticket links, and WhatsApp group invitations are automatically generated. CPRC is not responsible for emails that are filtered by your email provider.

​

4.3 Registration is personal and non-transferable. You may not transfer your registration to another individual without the prior written consent of CPRC.

 

4.4 CPRC programmes are open to Participants of all fitness levels. There is no minimum fitness requirement to register, unless specifically stated for a particular event or Programme.

 

4.5 CPRC reserves the right to refuse or revoke Registration at its discretion, including where a Participant poses a risk to themselves or others, or where behaviour is inconsistent with CPRC's community values. In such circumstances, a pro-rata refund may be considered at CPRC's sole discretion.

4.6 Attendance will be verified at each Session. Participants must be registered and paid to attend. Any person attending a Session without a valid Registration may be asked to leave.

​

4.7 Programme spots are limited and are allocated on a first-paid, first-served basis. CPRC does not hold spots without payment.

SECTION 05

PAYMENT & PRICING

5.1 All Programme fees are quoted and charged in South African Rand (ZAR) and are inclusive of VAT where applicable.

​

5.2 A ticket service fee may be charged by the Booking Platform in addition to the Programme fee. This fee is set by the Booking Platform and is not retained by CPRC.

​

5.3 Pricing tiers (e.g. Super Early Bird, Early Bird, General, Late) are time-limited and subject to availability. CPRC does not guarantee that any particular pricing tier will be available at the time of your Registration.

​

5.4 Payment must be made in full at the time of Registration. CPRC does not offer payment plans, split payments, or deferred payment arrangements unless explicitly agreed in writing.

​

5.5 CPRC reserves the right to amend pricing for future Programmes at any time. Changes to pricing will not affect confirmed registrations.

​

5.6 All payments are processed through the Booking Platform. CPRC does not store your payment card details. Payment security is governed by the Booking Platform's terms and security standards.

SECTION 06

CANCELLATION & REFUND POLICY

All Programme fees are non-refundable once payment has been made. By completing Registration you acknowledge that you have read, understood, and accepted this policy. CPRC may, at its sole and absolute discretion, consider refund requests in exceptional circumstances on a case-by-case basis. Such consideration does not constitute an entitlement to a refund.

 

6.1 No Refunds - General Rule. All Programme fees are non-refundable once payment has been made. This applies regardless of the reason for non-attendance or withdrawal, including but not limited to: change of mind, personal injury or illness, relocation, work commitments, scheduling conflicts, or failure to attend any or all Sessions.

​

6.1.1 Discretionary Exceptions. CPRC may, entirely at its own discretion and on a strictly case-by-case basis, consider a refund or credit in exceptional circumstances. The decision to grant or withhold any such refund or credit rests solely with CPRC and is final. A request for a discretionary refund does not create any entitlement to one. To submit a request, contact CPRC in writing at hello@couchpotatorunclub.co.za with full details of the circumstances before the Programme concludes.

​

6.2 Programme Cancellation by CPRC. In the event that CPRC cancels a Programme in its entirety prior to commencement, registered Participants will be offered either:

 

(a) a full refund of the Programme fee (excluding Booking Platform service fees), or

(b) a transfer to a future CPRC Programme of equivalent value, at CPRC's discretion.

​

6.3 Individual Session Cancellations. The cancellation or postponement of individual Sessions due to circumstances within or outside CPRC's control (including weather, safety concerns, or force majeure events) does not entitle a Participant to a refund or partial refund. CPRC will endeavour to reschedule cancelled Sessions where practically possible.

​

6.4 Missed Sessions. Participants who miss Sessions for any reason are not entitled to a refund, credit, or make-up Session unless CPRC expressly offers one. CPRC will, as a courtesy, provide missed session plans to assist Participants in keeping up with the Programme. This is a discretionary benefit and does not constitute a contractual obligation.

​

6.5 Removal from Programme. If a Participant is removed from a Programme by CPRC due to conduct in breach of these Terms, no refund will be issued for any remaining Sessions.

​

6.6 Transfer of Registration. CPRC may, at its sole discretion and upon written request, permit a Participant to transfer their Registration to a future Programme of equivalent value. No cash refund will be issued in lieu of a transfer. Any such transfer must be requested no fewer than 7 (seven) calendar days before the first Session of the Programme for which the Participant is registered.

​

6.7 Consumer Protection Act. Nothing in this cancellation policy is intended to exclude or limit rights that may be afforded to a Participant under the Consumer Protection Act 68 of 2008. Where such rights apply and cannot lawfully be excluded, they are preserved.

SECTION 07

Health, Medical & Physical Fitness

7.1 By registering for and/or attending any CPRC Programme, you confirm and warrant that you are in a suitable state of physical health to participate in a structured walking and running programme.

​

7.2 Medical Clearance. If you have or have had any of the following conditions, you must obtain written medical clearance from a registered medical practitioner before participating in any CPRC Programme: cardiovascular disease or any heart condition; high or low blood pressure; diabetes; any musculoskeletal injury or chronic joint condition; respiratory conditions including but not limited to asthma; any condition for which you are currently receiving medical treatment; pregnancy; or any other condition that may be adversely affected by moderate to vigorous physical exercise.

​

7.3 CPRC Coaches are not medical professionals. No information provided by a Coach, whether during a Session, in a WhatsApp group, or otherwise, constitutes medical advice. You should always seek the advice of a qualified medical practitioner regarding any health or injury concerns.

​

7.4 You are responsible for informing your Coach of any pre-existing injuries, medical conditions, or physical limitations before your first Session, and of any changes to your health or fitness status during the Programme.

​

7.5 If you feel unwell, faint, dizzy, experience chest pain, difficulty breathing, or any unusual physical symptoms during a Session, you must stop immediately and inform your Coach. CPRC accepts no responsibility for injury, illness, or adverse health outcomes arising from a Participant's failure to disclose relevant medical information or failure to cease participation when experiencing symptoms.

​

7.6 CPRC's programmes are beginner-level and designed for gradual progression. However, all forms of physical exercise carry inherent risks, including the risk of injury, and you acknowledge and accept these risks by participating.

SECTION 08

Indemnity & Assumption of Risk

Read This Section Carefully - It Affects Your Legal Rights

This section contains an assumption of risk and an indemnity in favour of CPRC. By accepting these Terms, you give up certain rights to claim against CPRC for harm suffered during participation in a CPRC Programme.

 

8.1 Assumption of Risk. You acknowledge that participating in running, walking, and related physical exercise involves inherent risks of personal injury, illness, or death, including risks arising from the actions or omissions of other participants, coaches, or third parties, and from environmental conditions such as weather, terrain, road surfaces, and traffic. You voluntarily assume all such risks.

​

8.2 Indemnity. To the maximum extent permitted by South African law, you hereby indemnify and hold harmless CPRC, its founders, coaches, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including legal costs) arising directly or indirectly from your participation in any CPRC Programme, including without limitation any personal injury, illness, death, loss of or damage to property, or any other loss howsoever caused.

​

8.3 This indemnity does not apply to losses caused by the gross negligence or wilful misconduct of CPRC or its Coaches.

​

8.4 Insurance. CPRC strongly recommends that all Participants hold adequate personal accident and health insurance to cover any injury, illness, or loss arising from participation. CPRC does not provide personal accident insurance to Participants.

​

8.5 Third Party Property. CPRC accepts no responsibility for any loss, theft, or damage to your personal belongings or equipment at or during any CPRC Session or event.

SECTION 09

Limitation of Liability

9.1 To the fullest extent permitted by applicable law, CPRC's total aggregate liability to any Participant, arising out of or in connection with a Programme or these Terms, whether in contract, delict, or otherwise, shall not exceed the total Programme fee paid by that Participant for the relevant Programme.

​

9.2 CPRC shall not be liable for any indirect, consequential, special, punitive, or incidental damages arising out of or in connection with your participation in a Programme, regardless of whether CPRC has been advised of the possibility of such damages.

​

9.3 Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, or any liability that cannot be excluded or limited under South African law, including under the Consumer Protection Act 68 of 2008.

SECTION 10

Participant Conduct & Programme Rules

CPRC is committed to creating a safe, inclusive, and supportive community for all Participants. The following conduct standards apply to all CPRC Sessions, WhatsApp groups, and events:

​

10.1 You must treat all Coaches, fellow Participants, and venue staff with respect at all times. Harassment, bullying, discrimination, intimidation, or abusive behaviour of any kind - whether in person, in a WhatsApp group, or via any other channel - will not be tolerated.

​

10.2 You must follow the reasonable instructions of your Coach at all times during a Session. Failure to do so may result in removal from the Session.

​

10.3 You must not attend a Session under the influence of alcohol, recreational drugs, or any substance that may impair your physical or cognitive function.

​

10.4 You must not share another Participant's personal information, contact details, or images without that Participant's explicit consent.

​

10.5 You acknowledge that CPRC's programmes take place on public roads, footpaths, and open spaces. You are responsible for your own safety in relation to traffic, pedestrians, and other hazards, and must comply with all applicable road traffic laws and pedestrian rules.

​

10.6 CPRC reserves the right to remove a Participant from any Session or Programme, and to revoke their access to CPRC's WhatsApp groups and community platforms, for any breach of these conduct standards. No refund will be issued in such circumstances.

SECTION 11

Programme Changes & Cancellations by CPRC

11.1 CPRC reserves the right to amend session dates, times, locations, coaches, or programme content at any time and for any reason, including operational requirements, safety concerns, or force majeure events. CPRC will provide reasonable notice of any such changes via the relevant WhatsApp group.

​

11.2 CPRC may cancel or postpone individual Sessions due to adverse weather, safety risks, insufficient participant numbers, or circumstances beyond CPRC's reasonable control. In such cases, CPRC will endeavour to reschedule the Session. No refund or credit will be issued for postponed or cancelled Sessions.

​

11.3 CPRC may cancel an entire Programme if the minimum number of registered Participants is not reached, or for any other legitimate operational reason. In such cases, registered Participants will be offered a full refund of the Programme fee or a transfer to an equivalent future Programme.

​

11.4 Force Majeure. CPRC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, government action or restriction, power failure, flood, fire, civil unrest, or any other event of force majeure. In such circumstances, CPRC's obligations shall be suspended for the duration of the force majeure event.

SECTION 12

Photography, Video & Intellectual Property

PHOTO & VIDEO CONSENT

CPRC Coaches and authorised CPRC representatives may photograph and/or video record Sessions and events for use in CPRC's marketing, social media, and promotional materials. By participating in a CPRC Programme, you provide your consent to being photographed or recorded in this context.

​

12.1 Consent to Photography and Recording. By registering for and/or attending a CPRC Programme, you grant CPRC a perpetual, royalty-free, worldwide licence to use your image, likeness, and voice as captured in photographs and video recordings taken at CPRC Sessions and events, for the purposes of marketing, social media, website content, press, and other promotional purposes.

​

12.2 Opt-Out. If you do not wish to be photographed or recorded, you must notify your Coach in writing (including via WhatsApp) before your first Session. CPRC will make reasonable efforts to exclude you from photographs and recordings, but cannot guarantee your complete exclusion from all media captured in a group setting.

​

12.3 CPRC will not knowingly share photographs or videos that identify a Participant in a manner that is unflattering, defamatory, or otherwise harmful.

​

12.4 CPRC Intellectual Property. All training programmes, interval plans, coaching materials, session plans, branding, marketing materials, and content produced by CPRC are the intellectual property of CPRC. You may not reproduce, distribute, sell, or repurpose any CPRC materials without prior written consent.

​

12.5 Nothing in these Terms grants you any licence to use the CPRC name, logo, branding, or trademarks.

SECTION 13

Personal Data & POPIA

CPRC is committed to protecting your Personal Information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA) and all other applicable data protection legislation.

​

13.1 Information We Collect. CPRC collects and processes the following Personal Information for the purposes set out in this section: full name; email address; contact telephone number; physical address (where provided); and any health or medical information you voluntarily disclose in connection with a Programme.

​

13.2 Purpose of Processing. Your Personal Information is collected and used for the following purposes: to administer your Registration and Programme participation; to send you session reminders, programme plans, and Programme-related communications; to add you to relevant WhatsApp groups; to process payments (via the Booking Platform); to contact you in the event of an emergency; and to send you information about future CPRC events and programmes (marketing communications).

​

13.3 Marketing Opt-Out. You may opt out of receiving marketing communications from CPRC at any time by notifying CPRC at the contact details in Section 20 or by following the unsubscribe instructions in any marketing email.

​

13.4 Sharing of Information. CPRC will not sell, rent, or otherwise transfer your Personal Information to third parties for their own commercial purposes. CPRC may share your information with its Coaches and authorised representatives for the purposes of Programme administration, and with the Booking Platform for payment processing purposes.

​

13.5 Retention. CPRC will retain your Personal Information for as long as is necessary for the purposes for which it was collected, or as required by applicable law, and will thereafter securely delete or anonymise it.

​

13.6 Your Rights. Under POPIA, you have the right to: request access to the Personal Information CPRC holds about you; request correction of inaccurate Personal Information; object to the processing of your Personal Information; and request deletion of your Personal Information, subject to CPRC's legal obligations. To exercise any of these rights, contact CPRC at the details in Section 20.

13.7 CPRC takes reasonable technical and organisational measures to protect your Personal Information against unauthorised access, loss, or disclosure, but cannot guarantee the absolute security of information transmitted electronically.

SECTION 14

WhatsApp & Communications

14.1 CPRC uses WhatsApp as its primary communication channel for Programme administration, session reminders, and community support. By registering for a Programme, you consent to being added to the relevant CPRC WhatsApp group and to receiving communications via WhatsApp.

​

14.2 CPRC WhatsApp groups are moderated by your Coach or an authorised CPRC representative. The conduct standards set out in Section 10 apply in full to all communications within CPRC WhatsApp groups.

​

14.3 You may not use CPRC WhatsApp groups to advertise commercial products or services, solicit other Participants, or share content that is offensive, defamatory, or otherwise inappropriate. CPRC reserves the right to remove any Participant from a WhatsApp group for breach of these rules.

​

14.4 CPRC is not responsible for any communications sent by individual Participants within a WhatsApp group and does not endorse the views expressed by Participants.

 

14.5 Information shared in CPRC WhatsApp groups by Coaches constitutes Programme support and communication only, and does not constitute professional medical, legal, nutritional, or financial advice.

SECTION 15

MINORS

15.1 Participants under the age of 18 must obtain the written consent of a parent or legal guardian before participating in any CPRC Programme.

​

15.2 The parent or legal guardian of a minor Participant must sign and submit CPRC's parental consent and indemnity form (available from CPRC on request) before the minor's first Session.

​

15.3 By accepting these Terms on behalf of a minor Participant, the parent or legal guardian confirms that they are legally authorised to do so and agrees to be jointly and severally liable with the minor for all obligations arising under these Terms.

​

15.4 CPRC reserves the right to refuse participation to any minor Participant where parental consent has not been obtained or where participation would, in CPRC's reasonable judgement, not be in the best interests of the minor.

SECTION 16

ANIMALS AT SESSIONS

16.1 Where CPRC has indicated that a Programme or Session is dog-friendly, Participants may bring dogs, subject to the conditions set out in this section. Not all CPRC Programmes or Sessions permit animals - this must be confirmed per Programme.

​

16.2 Dogs must be kept on a lead at all times during a Session. Participants are responsible for cleaning up after their animals at all times.

​

16.3 Participants who bring animals to a Session are solely responsible for the behaviour of their animals and indemnify CPRC, other Participants, and Coaches against any and all claims arising from injury, damage, or distress caused by their animal.

​

16.4 CPRC reserves the right to ask a Participant to remove their animal from a Session where the animal poses a risk to the safety or wellbeing of other Participants, Coaches, or members of the public.

SECTION 17

Governing Law & Disputes

17.1 These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of South Africa.

​

17.2 In the event of any dispute arising out of or in connection with these Terms, the parties agree to first attempt to resolve the dispute through good-faith negotiation. Either party may initiate this process by notifying the other in writing of the nature of the dispute.

​

17.3 If the dispute cannot be resolved through negotiation within 30 (thirty) calendar days, either party may refer the matter to mediation before a mutually agreed mediator, or if no agreement is reached on a mediator, to mediation administered by the Arbitration Foundation of Southern Africa (AFSA).

​

17.4 If mediation fails to resolve the dispute, the parties consent to the jurisdiction of the courts of the Republic of South Africa.

​

17.5 Nothing in this section prevents either party from seeking urgent interlocutory relief from a court of competent jurisdiction.

SECTION 18

AMENDMENTS

18.1 CPRC reserves the right to amend these Terms and Conditions at any time. The most current version of these Terms will always be available on the CPRC website at couchpotatorunclub.co.za.

18.2 Where amendments are material, CPRC will provide Participants who are currently enrolled in a Programme with reasonable notice of the changes via email or WhatsApp.

​

18.3 Your continued participation in any CPRC Programme following the publication of amended Terms constitutes your acceptance of those amendments.

SECTION 19

Severability

19.1 If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.

19.2 These Terms constitute the entire agreement between you and CPRC with respect to your participation in a CPRC Programme and supersede all prior agreements, representations, and understandings, whether written or oral.

​

19.3 No waiver by CPRC of any breach of these Terms shall be deemed a waiver of any subsequent breach.
